This Terms and Conditions sets out legally binding terms of use between the user of this site and Tofu Mart Ltd (The Company) that monitors and has ownership rights to the Site. By accessing and/or using the Site the user acknowledges that he/she has read and understood to agree to be legally bound by the terms and conditions set forth in this document. If you do not agree to abide by below terms and conditions, you are not permitted to access or use the Site. All text, graphics, design, content, and other works are copyrighted works of Company. The Company acknowledges proprietary rights of third parties displayed on the Site.

When you register, you will be given the option to receive information from The Company about products, promotions or special offers which we feel may be of interest to you. Our acceptance of an order takes place on dispatch of the order, at which point the purchase contract will be made and you will be charged for your order.

Applicable Law
These terms and conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

We may occasionally make changes to our terms and conditions. If this concerns you, you are advised to check the current terms and conditions prior to every purchase. International Use
The Company makes no promise that materials on www.doufu.co.uk are appropriate or available for use in locations outside the United Kingdom, and accessing www.doufu.co.uk from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so at your own initiative and are responsible for compliance with local laws.
Stock Availability
Active items may not be true to current availability and items you order may not be in stock. We will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to stock levels.
If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. Please note that we will attempt to deliver substitute lines should selected lines be unavailable unless you request us not to do so. You can also select to have the item removed from your order if you do not wish to accept an alternative product.
Substituted lines will normally be of identical or higher value (within an amount judged reasonable by The Company) than the original item ordered. In cases where the replacement item is of differing value, you will be charged the lesser of the two prices. If it is impossible to substitute an item, we will remove the item from the order and deduct the item price from the total order cost accordingly.
Although we will always try to cater for your orders, an order of large quantities of a line can only be fulfilled at our discretion. For example, if you were to make an order of 10 bottles of sake which would use up all of our stock, we may only deliver 5 bottles.
With fresh vegetable delivery, we may go via weight displayed. If a vegetable in stock is larger than that displayed, we reserve the right to send less individual items making up the total weight ordered.
Acceptance & Contract
There will be no contract of any kind between you and us unless and until we actually dispatch the goods to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us.
www.doufu.co.uk is available for non-commercial and domestic use only. The Company reserves the right to refuse orders from businesses or that we consider are for commercial or other non-domestic concerns.
Payment
Please note that for online sales we take payment at the point of dispatch. On some bank cards our initial check for sufficient funds, taken on receipt of your order, may appear like a payment on your statement. This is known as a 'Shadow Payment'. This amount is not taken by The Company, but taken by your bank and held, appearing like a transaction. We take one single payment on dispatch of the order and any amount held by your bank should be accredited back to your account within a week. Our online system allows for only one payment to be taken. If you have further queries about this 'Shadow Payment' please contact your bank. The Company will not take any responsibility should any extra charges be applied to you by your bank as a result of your bank holding to your 'Shadow Payment'.
All payments for doufu.co.uk are processed in British Sterling (£). Any other prices listed on doufu.co.uk are for guidance only and subject to international exchange rates and fees. Please check with your bank as to their policies on foreign payments and exchange rate fees.
Expiry Date on Payment Card
Please ensure that the expiry date of your payment card is after the date you place your order. Payment is taken when your order is ready to be posted and in the event that the payment card has expired we will be unable to take payment and fulfil your order.
Delivery by external courier (DPD/Parcel Force/Royal Mail/myHermes)
All our deliveries are carried out using the external couriers of either DPD, Parcel Force, Royal Mail, or myHermes depending on choice. As such we are subject to their terms and conditions.
Once your order has been received by us, we aim to dispatch your goods within 3 business days (Mon-Fri). However dispatch is subject to stocking levels, and for certain items (bakery in particular) there may be a long lead time. In such cases we will contact you for further instruction.
Once we have dispatched your goods, you should normally receive them within the timeframe of the delivery type chosen. However, while we maintain a close relationship with our delivery companies, and will attempt to rectify any delivery problems as soon as reasonably possible, the operation of the delivery companies we use is outside our control. Time of delivery shall not be subject to any contractual obligation, and The Company does not offer any guarantee that your order will arrive within the delivery time-frame chosen. In the event of the delay of delivery of your order or a mistake in the order itself, The Company accepts no liability for any associated expense, loss of profits or other losses incurred whatsoever. Failure to deliver on time will not entitle the customer to terminate their purchase contract with The Company, or refuse delivery. Returns should be made using the instructions below.
Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.
Delivery will be made to the address specified by you on the completed order form.
Chilled orders must be received on the day after dispatch. If you require chilled items to be delivered on a specific day, please contact us at hello@doufu.co.uk or place a note during checkout for your desired date of delivery and we will gladly do our best to arrange delivery as per your needs. Orders containing chilled items will not keep longer than the next day after dispatch and are not kept in chilled storage by the courier. The courier may offer the option to delay your chilled order to a later date by email, but please note that if selected, this may negate the potential of any refund on chilled items if a later date is chosen for chilled items.
We reserve the right to charge for any extra carriage costs incurred should the incorrect address be entered on your order. Until dispatch of your order please contact us to amend or add any delivery details.
www.doufu.co.uk can only be responsible for delivery to an address that has been registered with Royal Mail (www.royalmail.com). We cannot guarantee delivery to any addresses inputted that are not registered with Royal Mail.
Please note that P.O. Boxes are not acceptable for delivery addresses, as parcels usually require signature on delivery.
Refunds and Returns
The Company operates a returns policy in accordance with the UK Distance Selling Regulations allowing you to return any item within 14 days of receiving delivery of your order. Please note that any postage costs incurred when returning your items during this period will be at your own cost, unless the item is damaged, or was sent in error. If an order was placed with a promotional discount on postage, this may affect your refund amount if your total spend is no longer above the delivery offer requirements.
This policy does not extend to any items which have been opened or had their seal broken, perishable items (such as chilled, bakery, meat or vegetable items), and also does not include the refund of services carried out by The Company as part of your contract (e.g. handling costs). Items must be returned in pristine and resalable condition. This policy does not affect your statutory rights.
After the 14 day period we will be more than happy to accept items for return in any of the following cases:
- The item was found to be damaged or faulty. We will either replace the item or give you a full refund (including postage costs). Please state which option you would prefer. If you require a replacement, we will wait to receive the faulty copy from you before dispatching a new one.
- The item was incorrectly supplied. If we have made a mistake in fulfilling your order, a full refund (including postage costs) will be given.
- It must be in pristine and resalable condition.
- It must be accompanied by a copy of the delivery note or receipt.
Refunds on promotional items
Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected. Once we have taken the payment for your order and dispatched all the items, we are not able to offer refunds for any discounted items with limited expiry dates.
Short Shelf Life Items
If you choose to wait for any out of stock items from your order to come back in stock, please note that any limited expiry date items in this order will automatically be removed. If your order contains short shelf life items, you have agreed to accept responsibility for taking into consideration processing and delivery times and that these items therefore may arrive with you having exceeded the shelf life dates. We will not be liable in these instances.
Please note that we aim to send items with a shelf life of 1 month minimum, however exceptions do occur. Chilled items must be consumed by the date on each item.
Returns Instructions
Items supplied to customers should be returned in their original packaging to:

Please make sure you contact us before returning any item. Any item returned without our knowledge can potentially be refused. Please also note that the items remain your property until we have received them. You are therefore responsible for your goods while they are in transit to us. For your own protection we recommend using a secure recorded delivery method such as Royal Mail Special Delivery.
Provided the conditions above are met The Company will refund the item(s), and postage where applicable.
Please note that returns are accepted at the discretion of the The Company. If any goods returned do not adhere to the above policy, then we reserve the right to impose a charge proportionate with the costs of processing the items re-sale.
Refunds will be given in the same tender type as the original payment. Please allow 28 days (in addition to the delivery time) for the return and refund to be processed.
Product Information
Product summary details have been prepared for information purposes only, and are designed to enhance your online shopping experience on doufu.co.uk. While we have taken care in preparing this summary and believe it is accurate, it is not a substitute for you reading the product packaging and label prior to use. The Company is therefore unable to accept liability for any incorrect information.
Vegetarian dietary information covers products free from meat and fish to the best of our knowledge. In some cases products labelled vegetarian may include derivatives of fish or meat products, for which we are unable to accept liability due to the reasons stated above. Prices
We will make all reasonable efforts to present accurate information but we cannot guarantee the price or our ability to supply any particular item.
All prices shown on www.doufu.co.uk are to be seen as guide prices, and do not constitute an offer to sell. Formal formation of a contract and acceptance of your order only occurs once we dispatch your ordered goods from our store. Until we formally accept your order, placement of an order will constitute an offer to purchase. Occasionally our suppliers may increase their prices unexpectedly, and this is often something we become aware of only upon ordering stock from them. In the event that this occurs, or in the event of a pricing error howsoever caused, we will check with you to see if you still wish to receive the item at the new price. All prices are displayed in pounds sterling (£), and include VAT where applicable.
Please note that promo codes when entered during to checkout are not applicable for any items already on discount, or excluded from the promo code as stated in their individual T&Cs.
Miscellaneous
You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions.
If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.
If you breach these terms and conditions and The Company ignores this, The Company will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the terms and conditions.
The Company shall not be responsible for any breach of these terms and conditions caused by circumstances beyond its control.
A person who is not a party to these terms and conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
